Tailored to your property.
Scaffold hire periods to suit your project.
London, Surrey, Sussex, Hampshire, Berkshire & Kent.
Provided where required.
These Terms and Conditions apply to scaffolding services supplied by Mays Scaffolding (“we”, “us” or “our”) to the person, company or organisation ordering the work (“the Customer”).
They should be read together with the quotation or other written agreement supplied for the individual project. Where a quotation contains terms or requirements specific to a particular project, those project-specific terms will also form part of the agreement.
Our quotations are based on the information available to us at the time, including information supplied by the Customer and conditions visible or reasonably identifiable during any site visit.
Unless otherwise stated, quotations are provided in Pounds Sterling (£) and VAT will be added where applicable at the prevailing rate.
A quotation covers only the scaffolding, access, hire period and associated work specifically described within it.
If site conditions, access requirements, dimensions, working requirements or other relevant circumstances differ materially from those on which the quotation was based, we may revise the price accordingly.
Unless a different period is stated on the quotation, quotations remain valid for 30 days from the date of issue.
Acceptance of our quotation constitutes acceptance of these Terms and Conditions.
Work will be scheduled once the quotation has been accepted and any deposit or advance payment specified in the quotation has been received.
Any requested commencement or completion dates are subject to availability and confirmation by us.
The scaffold will be constructed for the purpose and areas described in the quotation.
The Customer must tell us before work begins about the trades that will use the scaffold and any particular requirements affecting its construction, including required working heights, platform positions, loading requirements, temporary roofing, sheeting, netting, loading bays, hoists or other specialist requirements.
Unless agreed otherwise, additional scaffolding or alterations requested after work has commenced will be treated as a variation and may result in an additional charge.
The Customer must provide suitable and reasonably unobstructed access to the site for our vehicles, materials and operatives.
The Customer must inform us before work begins of any known restrictions that could affect delivery, erection, alteration or dismantling.
This includes, where applicable, restricted entrances, parking restrictions, controlled access, neighbouring property, conservatories, extensions, fragile surfaces, underground services, overhead cables or other hazards.
If we are unable to carry out scheduled work because suitable access has not been provided or the site is not ready, we reserve the right to charge for the additional visit and associated labour, transport and other reasonable costs.
The Customer must disclose any known information that may affect the suitability of the ground, roof, structure or other surface supporting the scaffold.
This includes cellars, basements, underground tanks, drains, voids, fragile roofs or surfaces and other concealed features that may affect load-bearing capacity.
Where specialist information, structural calculations or a scaffold design are required, these will be dealt with as agreed in the quotation or separately with the Customer.
Where a scaffold falls outside a recognised standard configuration or otherwise requires a bespoke design, suitable design information must be available before the relevant scaffold is constructed.
Where scaffold design is included within our quotation, this will be stated.
Where design work becomes necessary because of information or requirements that were not made known when the original quotation was prepared, additional design and associated costs may be charged separately.
Where scaffolding is to occupy or project over a public highway, pavement or other area requiring permission, an appropriate licence or permit may be required from the relevant authority.
Responsibility for obtaining and paying for licences, permits, parking suspensions and other permissions will be as stated in our quotation.
The Customer is responsible for obtaining permission from neighbouring property owners, landlords, managing agents or other third parties where their land or property needs to be accessed or used unless we have specifically agreed otherwise in writing.
We cannot be held responsible for delays resulting from permissions or licences that have not been obtained in time.
Scaffolding will be erected by competent personnel in accordance with the requirements applicable to the scaffold being supplied.
The Customer must ensure that other contractors, occupants and visitors do not obstruct our operatives while erection, alteration or dismantling work is taking place.
We may stop work where we reasonably consider that site conditions create an unacceptable safety risk.
Where applicable, a scaffold handover certificate will be provided following completion of the scaffold.
The handover relates to the scaffold in the condition and configuration in which it was supplied.
Any unauthorised alteration may invalidate the basis upon which the scaffold was handed over and may make it unsafe to use.
Once a scaffold is in use, it is the Customer’s responsibility to ensure that any inspections required by applicable health and safety legislation are arranged and carried out by a competent person unless we have specifically agreed in writing to provide an inspection service.
The Customer should also ensure that additional inspections are arranged following circumstances that could affect the scaffold’s safety, including significant alteration, damage or severe weather where appropriate.
Any inspection service supplied by us will be subject to the scope and frequency agreed with the Customer.
The scaffold must not be altered, adapted, dismantled or added to by the Customer or any third party without our prior agreement.
This includes removing or moving:
scaffold ties;
tubes or fittings;
boards;
guardrails;
toe boards;
braces;
ladders;
ladder gates;
beams;
sheeting or netting; or
any other structural or safety component.
If an alteration is required, the Customer should contact us so that it can be assessed and carried out by competent scaffolders.
We reserve the right to charge for alterations or additional visits that fall outside the original quotation.
Scaffold ties form an important part of many scaffold structures and must not be removed, loosened or altered by anyone other than an authorised scaffolder.
Where work to the building conflicts with the position of a scaffold tie, the Customer or contractor must contact us before removing or interfering with it.
We can assess whether the tie can be relocated or whether another method of restraint is required.
Sheeting, netting, shrink wrap and temporary roof coverings can substantially change the wind loading imposed on a scaffold.
No sheeting, netting, advertising banner, tarpaulin or other covering may be attached to the scaffold unless it has been included within the scaffold specification or we have approved it.
Customers and other contractors must not add coverings to a scaffold themselves.
Temporary roofs are temporary weather-protection structures and cannot be guaranteed to make a building completely watertight in all weather conditions.
The scaffold must only be used for the purpose for which it has been provided.
The Customer must ensure that the scaffold is not overloaded and that materials are not stored on working platforms beyond the loading for which the scaffold has been constructed.
Nothing should be thrown or dropped from the scaffold.
The Customer is responsible for controlling access to the scaffold while it is on site and for taking reasonable measures to prevent unauthorised use.
Children and unauthorised persons must not be permitted to climb or use the scaffold.
We will take reasonable care when erecting, altering and dismantling scaffolding.
Scaffolding necessarily involves contact with or work close to buildings, roofs, walls, paving and other surfaces.
The Customer should tell us before work begins about particularly fragile, concealed or sensitive finishes and surfaces.
We will not be responsible for pre-existing defects or damage arising from defects, weaknesses or conditions that could not reasonably have been identified before work commenced.
Nothing in these Terms excludes liability where it cannot lawfully be excluded.
Scaffolding can provide access to parts of a property that would normally be difficult to reach.
Unless specifically included in our quotation, the provision of scaffold alarms, security systems, lighting or other security measures is not included within our service.
The Customer remains responsible for the security of the property and should consider whether additional security precautions are appropriate while scaffolding is present.
The included hire period will be stated in the quotation.
The hire period begins on the date specified in the quotation or, where no separate date is specified, when the scaffold has been erected and made available for use.
If the scaffold is required beyond the included hire period, additional hire charges may apply.
The Customer should contact us as early as possible if an extension is required.
Continued presence of the scaffold beyond the original hire period does not mean that additional hire is provided free of charge.
The Customer must tell us when the scaffold is no longer required.
Where possible, reasonable notice should be provided so dismantling can be scheduled.
The Customer must ensure that the scaffold is clear of materials, waste and equipment belonging to the Customer or other contractors before dismantling takes place.
Dismantling dates are subject to scheduling, weather, access and safe working conditions.
Hire charges may continue where removal is delayed because the Customer has not made the scaffold or site available for dismantling.
We will make reasonable efforts to carry out work within agreed timescales.
However, dates may need to change because of weather, unsafe working conditions, access problems, transport disruption, shortages, licence delays, changes requested by the Customer or circumstances outside our reasonable control.
If our operatives attend the site but cannot carry out the agreed work because the site is not ready, access is unavailable or another contractor prevents the work from proceeding, we may charge for the abortive visit and any resulting additional costs.
Any work requested outside the original quotation may be treated as additional work.
Examples include:
extending the scaffold;
increasing working-platform depths;
adding lifts;
moving or adding scaffold ties;
additional ladder access;
loading bays;
beams;
temporary roofs;
sheeting or netting;
additional edge protection;
returning to alter the scaffold for another trade; or
additional erection or dismantling visits.
Where practicable, the price for additional work will be agreed before it is carried out.
Emergency or safety-critical work may need to be undertaken immediately where reasonably necessary to make the scaffold safe.
Scaffolding work may be delayed or suspended where weather conditions make erection, alteration or dismantling unsafe.
High winds, storms, snow, ice, extreme temperatures and other adverse conditions can affect safe working.
We will not require our operatives to continue working where we reasonably consider conditions unsafe.
All scaffold equipment supplied by us remains our property unless expressly sold to the Customer.
The Customer must take reasonable care to prevent loss, theft, deliberate damage or unauthorised removal of equipment while it is on site.
The Customer must inform us promptly if scaffold equipment is damaged, stolen or interfered with.
Where loss or damage results from misuse, theft, vandalism, unauthorised alteration or the actions of the Customer or its contractors, we may charge the Customer the reasonable cost of repair or replacement where legally permitted.
Payment terms will be stated on the quotation or invoice.
Deposits, stage payments or payment before erection may be required depending on the project.
Invoices must be paid within the period stated on the invoice.
Where payment becomes overdue, we reserve the right, subject to applicable law, to suspend further work and take reasonable steps to recover sums properly due.
For commercial customers, we may also exercise any statutory rights available to us in respect of late payment.
If the Customer wishes to cancel work after accepting a quotation, they should contact us as soon as possible.
Any cancellation charge will take account of the circumstances and, where applicable, work already undertaken, materials or services specifically ordered, committed labour, transport, design work and other costs reasonably incurred.
Where the Customer is acting as a consumer, nothing in these Terms affects any statutory cancellation rights that apply to the contract.
The Customer is responsible for providing accurate information about the work for which the scaffold is required.
The Customer must also tell us about known hazards or circumstances that could affect our work, including asbestos, overhead or underground services, unstable structures, restricted access, hazardous materials and other relevant site conditions.
Where several contractors are working at the property, the Customer or person controlling the site is responsible for appropriate coordination between those contractors.
The Customer and anyone using the scaffold must comply with applicable health and safety requirements and any reasonable safety instructions provided by us.
The scaffold must not be used where it is known or suspected to have been damaged, substantially altered without authorisation or otherwise made unsafe.
If there is any concern about the condition of a scaffold, use should cease where necessary and we should be contacted.
We will perform our services with reasonable care and skill.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Subject to those rights and any statutory protections applying to consumers, we will not be responsible for losses caused by circumstances outside our reasonable control or by the Customer’s failure to comply with these Terms.
Where the Customer is acting in the course of a business, we will not be liable for indirect or consequential loss, loss of profit, loss of business or loss of opportunity except where such liability cannot lawfully be excluded.
We will not be responsible for delay or failure to perform our obligations where caused by circumstances beyond our reasonable control.
These may include severe weather, fire, flood, industrial disputes, transport disruption, government restrictions, shortages of materials, failure of third-party services, emergencies or other events that could not reasonably have been avoided.
We will make reasonable efforts to minimise disruption and resume work when it is safe and practicable to do so.
If the Customer has a concern regarding our work or the scaffold supplied, they should contact us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, rectify the matter.
Where a concern relates to safety, the Customer should contact us immediately and prevent use of the affected area where necessary.
Nothing in these Terms and Conditions is intended to restrict the statutory rights of a Customer acting as a consumer.
Where consumer law gives the Customer rights or remedies that cannot legally be excluded or restricted, those rights and remedies will continue to apply regardless of anything stated in these Terms.
The quotation, these Terms and Conditions and any written variations or project-specific documents agreed between us form the basis of the contract.
Where the Customer is acting in the course of a business, they should not rely upon statements or representations that have not been confirmed as part of the written agreement.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
These Terms and Conditions and any contract between the Customer and Mays Scaffolding will be governed by the laws of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights available to consumers.
